1. Introduction & Business Scope

Pooja Trading Co. (“Company”, “we”, “us”, or “our”) operates as an authorised wholesale distributor and trade stockist of water storage tanks, piping systems, industrial infrastructure products, PUF sandwich panels, and sanitaryware from our central warehouse in Bhiwandi, Maharashtra.

These Terms & Conditions govern all wholesale inquiries, formal Bill of Quantities (BOQ) price quotations, purchase orders, dispatch schedules, and commercial supplies executed between Pooja Trading Co. and commercial purchasers, builders, plumbing contractors, industrial buyers, and housing societies.

2. Quotations, Pricing & Validity

All quotations issued by our sales desk via formal letterhead, email, or WhatsApp are customized based on order volumes, product specifications, and site logistics requirements.

• Validity Period: Due to continuous raw material market variations (polymers, brass, PVC, steel, and polyurethane), quotations remain valid for seven (7) calendar days from the date of issue unless explicitly noted otherwise.
• Taxes & Statutory Levies: All quoted rates are exclusive of Goods and Services Tax (GST) unless expressly stated as GST-inclusive. GST will be levied at the prevailing statutory rate (e.g., 18% or applicable HSN rate) on the final tax invoice.
• Volume Tiers: Volume discounts apply strictly to the agreed aggregate quantities specified in the quotation. Partial withdrawals or reductions in quantity may warrant a recalculation of unit prices.

3. Payment Terms & Invoicing

Trade transactions are executed against advance RTGS/NEFT, cleared banking instruments, or pre-approved institutional credit arrangements:

• Goods are dispatched upon receipt of confirmed banking clearance or per mutually signed project credit terms.
• Official GST-compliant tax invoices and e-Way bills accompany every shipment to ensure uninterrupted transit and legal tax input compliance.
• Custom fabricated consignments (such as modular SMC panel tanks, specific PUF panel thicknesses, or custom FRP cover dimensions) require a minimum 50% non-refundable advance prior to factory production.

4. Dispatch, Freight Logistics & Delivery

We coordinate dispatches locally across Bhiwandi, Thane, Kalyan, Mumbai, Navi Mumbai, and the MMR within 24 to 48 hours for stocked lines. State-wide consignments across Maharashtra and pan-India project loads are scheduled to match site construction milestones:

• Delivery Location: Delivery is made to the specified site address accessible by commercial cargo vehicles (tempo, 14-ft, 20-ft, or 40-ft trailers).
• Site Offloading: Unless specifically quoted and agreed in writing as “including offloading and crane lifting”, freight transport is curbside delivery. Offloading, crane positioning, and internal site shifting are the sole responsibility of the consignee.
• Demurrage & Unloading Delays: Vehicles must be offloaded promptly upon arrival. Extended site detention caused by consignee readiness will incur transporter demurrage charges at actual cost.

5. Inspection, Receipt & Damage Reporting

The consignee or their authorized site supervisor must verify consignment count and physical condition upon delivery:

• Any visual transit breakage (particularly for vitreous sanitaryware, ceramic fittings, or acrylic accessories) or package shortage must be recorded immediately on the transporter’s Lorry Receipt (LR) / Delivery Challan.
• Written notification along with clear photographic evidence must be submitted to poojatrading@gmail.com or our sales desk within 24 hours of delivery.
• Goods once unloaded, signed for without exception, and moved into site storage are deemed accepted in full and satisfactory condition.

6. Manufacturer Warranties & Liabilities

All products distributed by Pooja Trading Co. are 100% genuine, factory-original items sourced through authorised manufacturer channels (Sintex, Prince Pipes, Astral, Hindware, Thermodrain, Kingspan Jindal, Johnson, Nirali, Viega):

• Official manufacturer warranties (e.g., Sintex 10-year/5-year tank warranties, Prince pipe standards, Hindware ceramic warranties) are extended directly by the respective manufacturers.
• Pooja Trading Co. facilitates factory technical inspections and warranty claims with the manufacturer’s service department.
• To the maximum extent permitted by law, our liability is strictly limited to the invoice value of the defective goods supplied. We are not liable for incidental, indirect, or consequential losses resulting from improper installation, incorrect engineering sizing, or site mishandling.

7. Governing Law & Jurisdiction

All purchase orders, contracts, and commercial dealings shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, arbitration, or proceeding arising out of or in connection with transactions shall be subject to the exclusive jurisdiction of the competent courts in Thane / Bhiwandi, Maharashtra.
